1. Scope of Application

These Terms and Conditions apply to all business transactions between Brand Discovery (sole proprietorship of Keanu, Basel-Stadt, Switzerland, hereinafter “Provider”) and customers (hereinafter “Customer”) in connection with the purchase of digital products (e.g. e-books) and the booking of services in the fields of search engine optimisation (SEO), website creation and digital marketing via the website www.brand-discovery.club.

By completing a purchase or using a service, the Customer agrees to these Terms and Conditions.

2. Services

The Provider offers digital products for instant download (e.g. e-books) as well as custom or fixed-price services, especially in the following areas:

• SEO consulting and optimisation

• Creation and optimisation of websites

• Online marketing consulting and implementation

• Sale of e-books and digital resources

The type and scope of services are defined in the respective service descriptions on the website or in individual agreements.

3. Conclusion of Contract

A contract is concluded either through:

• the purchase of a digital product via the website, or

• the written confirmation (e.g. by email or platform message) of a custom offer by the Customer.

4. Prices and Payment Terms

All prices are listed in Swiss Francs (CHF), unless stated otherwise. The prices applicable at the time of the contract apply.

Payments are processed via the payment providers PayPal or Zahls.ch, who offer various methods such as credit card, Twint or bank transfer. Data processing and transaction handling are carried out by the respective payment providers.

5. Delivery and Access to Digital Products

Once payment has been completed, the Customer gains immediate access to the purchased digital products. Access is provided via a personal customer account on the website. Registration is required to access digital content.

6. No Right of Withdrawal for Digital Products

By accessing the digital product after purchase, the right of withdrawal expires, as the product is a digital service delivered immediately (Art. 40f lit. b CO in conjunction with Art. 3 para. 1 lit. b Distance Selling Ordinance). The Customer expressly agrees to waive the right of withdrawal.

7. Services and Cancellations

For custom services, the scope, schedule, and payment terms are defined in the respective agreement.

A cancellation by the Customer is only possible before the service begins and must be submitted in writing. Services already started cannot be refunded.

8. Disclaimer of Liability

The Provider does not guarantee specific business or technical results (e.g. search engine rankings, revenue growth). Responsibility for implementation lies with the Customer.

To the extent permitted by law, any liability for direct or indirect damages, consequential damages, or loss of profit is excluded.

9. Copyright and Usage Rights

All content, especially e-books, templates, and texts, is protected by copyright. Upon purchase, the Customer is granted a non-transferable, non-exclusive licence for personal use. Redistribution, reproduction, or commercial use is prohibited.

10. Data Protection

The Provider’s privacy policy as published on the website applies. Tracking and analytics tools are used for marketing purposes, as well as email marketing (e.g. newsletter). Consent can be withdrawn at any time.

11. Jurisdiction and Applicable Law

Swiss law exclusively applies. The place of jurisdiction is Basel-Stadt, Switzerland.

12. Amendments

The Provider reserves the right to amend these Terms and Conditions at any time. The version in effect at the time of the transaction applies.
